Intel sues over

In its filing, Intel claims that Intelspec uses a “name and mark that wholly incorporates and emphasizes the world-famous Intel trademark.” According to Intel, the result is confusion and assumptions that Intel may be the source or sponsor of the goods and services provided by Intelspec – or “that there is an association” between the two companies. Intel also claims that Intelspec dilutes the Intel trademark.

The chip maker is asking for a judgment that would, at Intel’s discretion, cancel or transfer all rights to the intelspec.com domain name to Intel. Intel also wants a judgment that forces Intelspec to “cancel or modify” its corporate name, as well as a reward for damages and profits Intelspec has taken because it was using “Intel” in its name.

The suit is somewhat strange as Intelspec is not even remotely active in a segment that would affect Intel’s core business. Intelspec is a construction and engineering firm that is, for example, taking contracts for waste management facilities, mining, oilfield infrastructure, as well as military and government construction. Only lawyers may be able to understand how Intelspec could have capitalized in its business by using “Intel” as part of its name.

This one just doesn’t look right and it may be common sense to see that it would take quite a bit to confuse a construction firm with a chipmaker, as long as we aren’t considering fab construction. In that case, Intel could argue that there may be confusion, but it would be tough to prove that Intel’s interests have been damaged as a result of that circumstance. Intelspec does not have a trademark on its name.

However, the trademark suit follows a series of previous trademark complaints. In June of this year, Intel filed a complaint with the WIPO Arbitration and Mediation Center that asked for the cancellation or transfer of 15 different domain names that included the “Pentium” trademark.

Only 3.4 million Honeycomb tablets in the wild?

Google’s rolling in the dough in no small part due to Android’s success in the smartphone market. What about the stat for the tablets? Eh, not so much. Intrepid developer Al Sutton figures that only 3.4 million Honeycomb devices are currently in use, which pales greatly in comparison to the number of slates sold by the competition in Cupertino.

He arrived at the figure using Google’s data — Larry Page said that there are 190 million Android devices out there on yesterday’s earnings call, and the Android Developers website shows that only 1.8 percent of ‘droids accessing the Android Market during a recent two week period were running Google’s tablet OS. Do the math, and that’s just 3.42 million tablets running Android 3.x.

It’s hardly an official figure, but it does indicate that Android’s got its work cut out for it the tablet space. That Ice Cream Sandwich better be mighty tasty if the bots from Mountain View are going to grab a bigger chunk of the market.

Clarkson contract blunder leads to cancellation of Top Gear TomTom GPS

Those of you hoping to hear the boisterous voice of Jeremy Clarkson coming out of your TomTom GPS are going to be quite disappointed. As it turns out, part of the BBC’s editorial guidelines state that none of the Top Gear presenters can endorse motoring products, and thus, having Clarkson screaming out of your TomTom is a clear violation of this policy.

Some 54,000 units of the Clarkson-ified TomTom have already been produced, with many already in stores. BBC Worldwide has stated that it will now donate all proceeds from the TomToms to the Children In Need charity. The BBC told UK’s The Guardian that Jezzeh was in no way involved with setting up this deal and will not make any money from the partnership between BBC and TomTom.

Looks like drivers will now be forced to add in their own insults, sarcasm and humor to the TomTom sat-nav experience.

Dutch court turns down Samsung's request to block Apple products

There’s still no further word on Samsung’s recent attempt to block sales of the iPhone 4S in France and Italy, but the company’s now been dealt a blow in its similar efforts in the Netherlands. According to Reuters, a Dutch court has turned down Samsung’s request for a ban on certain Apple products, and rejected claims that they infringe on Samsung’s patents (it’s also rejected Apple’s counterclaims in the case). The particular patents in question here are not related to software or the design of the devices, as in other cases, but rather their 3G capabilities, which Samsung had claimed Apple was infringing on with the various iterations of the iPhone and iPad.

Electronic Arts offering chance to win new Porsche

Electronic Arts seems hell bent on capitalizing on its unique deal with Porsche, announcing a new contest to win a 2012 911 Carrera S as part of a promotion for its upcoming Need For Speed: The Run video game. Apparently, all you need to do to be entered into the giveaway is log into your EA account or register a new account for free. No actual purchase of the game is necessary.

Naturally, there’s some fine print – the contest is only open to people living in the United States, Canada or the UK, for instance. We know there are some angry (and very vocal) fans of the Forza series out there holding a Porsche-shaped grudge against EA, but we’re guessing even the hardest of the hardcore Forza fans of the world would be willing to accept a free Carrera as at least partial compensation…

Watch Kenneth Moen drifts a hillclimb with his bonkers Toyota Supra turbo

Nothing incinerates a perfectly good set of tires better than a drift car. And no drift car makes as much smoke as Kenneth Moen’s turbocharged Toyota Supra. Yes, Ken Block turns out some great videos with high production values and plenty of tail-wagging craziness… but wait ’til you get a load of this.

Moen pointed his battle-scarred Supra in the general direction of ‘up’ at the Lysgårdsbakkene Ski Jumping Arena in Lillehammer, Norway, a facility you may recall from the 1994 Winter Olympics. Smoke-filled antics ensued, and it was all captured on video for your viewing pleasure.

A week ago we heard that a mysterious big box retailer would be getting a kid-friendly flavor of Motorola’s Xoom tablet, and now Best Buy has come forth to make things official with the Xoom Family Edition. Everything seems to be in line with what we already knew, including the $40 software bundle — yes, yes Zoodles comes preloaded, as does Asphalt 6 and SIM City Deluxe. And after the kids are done playing, mom and dad can catch up on homework with Quickoffice Pro HD. The Android 3.1-powered tablet includes a rather modest 16GB of storage, and will run you $379 when it hits Best Buy stores on this Sunday.

BMW F30 3 Series unveiled, market debut in Feb 2012

BMW has unveiled its sixth-generation 3 Series in its sedan form, and the F30 will roll in with plenty to offer aficionados when it makes its market debut beginning Feburary 11 next year.

At point of launch, the car will be available with four engine choices, all TwinPower Turbo units. The range topper is the 335i, with its 3.0 litre, 306 hp and 400 Nm mill leading the way. Next is the 328i, which sees the 2.0 litre petrol TPT unit offering 245 hp at 5,000 to 6,500 rpm and 350 Nm at 1,250 – 4,800 rpm.

The remaining two are diesel jobs, these being the 320d and the 320d EfficientDynamics Edition. Both run a 2.0 litre commonrail DI variable geometry turbocharged block, with differing outputs – the 320d ED Edition puts out 163 hp, while the 320d offers 184 hp, both at 4,000 rpm. Torque figures are identical, with both offering 380 Nm at 1,750 – 2,750 rpm.
